AVALON POLICE DEPARTMENT

For your safety and the safety of others we are offering you a list of laws and regulations governing the following activities:

EMERGENCIES DIAL 9-1-1! The 9-1-1 system in the state of New Jersey is for Emergencies only. An emergency constitutes threats to Life, Liberty or Property. For all other police related non emergency calls dial 609-967-3411.

BICYCLING: The following are required:

1. At night a front white headlight and a rear red lamp
2. A bell or horn
3. Limit passengers to the number of seats
4. NO HITCHING onto other vehicles
5. Bicycles are granted all the rights and subject to all the duties of a vehicle driver
6. Operate as near to the right side as practical, single file in the same direction as traffic
7. Where applicable marked bicycle paths MUST be used while on Dune Drive
8. At all times helmets are required for seventeen and under (recommended for all bicyclists)
9. Riding of bicycles on the sidewalk within the business district is prohibited

Please make every effort to secure bicycles when not in use or stored at your residence. A good quality bike chain and lock is recommended.

ROLLER BLADERS:

1. Use the extreme left portion of the roadway facing approaching traffic

SKATE BOARDERS:

1. The same laws as roller bladders applies to skate boarders 2. Private property should be used ONLY with the permission of the property owner 3. The borough has a fully functional skate board park located at 30th and Avalon Avenue. Please visit the Avalon Recreation Department at 31st and Avalon Ave for more details

JOGGING/WALKING:

1. This must be done on the sidewalks (where provided) 2. Don't walk in roadway where there are sidewalks 3. Joggers and walkers will stay to the extreme left side of the shoulder facing approaching traffic

During the summer our pedestrian and motor vehicle traffic increases. For your safety adherence to these laws and regulations are necessary and vital. The Avalon Police Department hopes these rules aid you during your stay in Avalon.

LOW SPEED VEHICLES (LSV's):

NJ Title 39 violations covering LSV's:

Low Speed Vehicles (LSVs) must be titled, registered and insured in New Jersey. However, they are not subject to regular vehicle inspection.

An LSV is a four-wheeled vehicle with an attainable speed of more than 20 miles per hour but no more than 25 miles per hour on a paved surface. It cannot be powered by gas or diesel fuel and must comply with federal safety standards as noted in 49 CFRs. 571.500. An LSV is NOT and may NOT be a modified golf cart.

If you operate an LSV please follow these guidelines:

  • You may not drive LSVs on roadways with speed limits that exceed 25 mph. (In limited cases, if deemed appropriate by a municipality, county or DOT, LSVs may be permitted on roadways with speed limits that do not exceed 35 mph)

  • You should watch for and abide by road signs prohibiting use even on lower speed roads

  • LSVs cannot be modified golf carts

  • All LSVs must have a 17-digit Vehicle Identification Number

  • Child restraints in LSVs must meet the same standards as those used in passenger vehicles

  • You must have a valid driver license to operate a LSV

  • You may lease or rent properly titled, registered and insured for temporary use

  • An LSV may be registered in the name of an individual, business or government entity, but may not be used as a commercial vehicle

  • You are subject to the same violations as other vehicles (except for the regular inspection requirements)

  • All LSVs shall have a safety information decal provided by the manufacturer on the rear of the vehicle

  • If you have only one license plate, you should put it on the rear of the car

  • LSVs must meet Federal and State requirements

License plates: LSV plates are standardized plates with letters "LSV" (in most circumstances). "Low Speed Vehicle" will be inscribed on the bottom of the plate. Only one plate will be issued for non-government owned vehicles and should be affixed to the rear of the vehicle.

  • You cannot register handicapped plates on LSVs. Use placards when necessary

  • You can transfer a plate to another LSV, but not to a different type of vehicle

Insurance requirements LSVs are specialty vehicles and coverage will be available through the New Jersey Personal Automobile Insurance Plan (NJPAIP) and other voluntary insurers. Contact an insurance agent or broker for more information.

Federal requirements Low Speed Vehicles cannot exceed 25 MPH and must be equipped with:

  • Headlamps

  • Front and rear turn signal lamps

  • Tail lamps

  • Stop lamps

  • Red reflex reflectors: one on each side as far to the rear as possible and one on the rear of the vehicle

  • An exterior mirror mounted on the driver's side of the vehicle and either an exterior or interior mirror mounted on the passenger's side

  • A parking brake

  • A windshield that meets federal safety requirements (effective until Nov. 1, 2006)

  • A Vehicle Identification Number

  • A Type 1 or Type 2 seat belt assembly conforming to Sec. 571.209, installed at each designated seating position

State requirements (S1834) LSVs operated on any public road or highway in the state shall be maintained in proper condition and comply with equipment requirements and standards:

  • Adequate brakes to control the movement of the vehicle

  • An odometer

  • A speedometer

  • The original manufacturer's VIN die-stamped on the body and/or frame, engine or motor of the vehicle

  • A safety information decal provided by the manufacturer must be in a conspicuous place on the rear of the vehicle displaying "25 MPH Vehicle"

MOTOR SCOOTERS AND ELECTRONIC PERSONAL ASSISTIVE MOBILITY DEVICES (EPAMD)

·Electronic Personal Assistive Mobility Devices (Rascal, Segway etc) Are legal and allowed to be operated on the Public roadways and bike paths of the State of NJ. The main difference being that they are Electric. They must follow all rules under title 39 chapter 4, HOWEVER 39:4-14.11 states that they SHALL receiove a warning for the first offence. A DL and registration is NOT required for this.

·Motorized scooters(N.J.S.A. 39:4-14.12 through 39:4-14.15; N.J.S.A. 39:1-1)

·A motorized scooter is a miniature motor vehicle. Although it is illegal for these vehicles to be driven on any public road or sidewalk, except on designated municipal or county property, motorists must be very alert if these types of vehicles are present. Motorized scooters are extremely hard to see.

·Motorized scooters must be registered in the municipality or county where the owner resides and must be insured. No one under the age of 12 (the age determined by a municipality or county) is permitted to operate a motorized scooter.

·Examples of a motorized scooter include but are not limited to:

·• Pocket bikes andSuper pocket bikes • Scooters • Mini-scooters • Sport scooters • Mini-choppers • Mini-motorcycles • Motorized skateboards • Other vehicles with motors not manufactured in compliance with Federal Motor Vehicle Safety Standards and which have no permanent Federal Safety Certification stickers affixed to the vehicle by the original manufacturer

·The following are not motorized scooters:

·• Electric personal mobility-assisting devices • Motorized bicycles or low-speed vehicles • Motorized wheelchairs • Mobility scooters or similar mobility-assisting devices used by persons with physical disabilities or persons whose ambulatory mobility has been impaired by age or illness
